Third Citation is inaccurate.[edit]

Mezei was a lawful permanent resident - not an "unauthorized immigrant for 25 years." Page 216 of the opinion, as cited in footnote 3 of this article, does not support the proposition cited. The proposition, that he was an unauthorized immigrant, is not supported by the citation. In fact, the citation supports the opposite conclusion.

On page 216 of the opinion, he is called a "resident alien." "Alien" meaning "noncitizen" and "resident" meaning "lawfully admitted." If he were unauthorized, he would have been referred to as an "unauthorized alien" - a noncitizen who was not lawfully admitted.

Furthermore, on page 213 of the opinion, the Court says: "To be sure, a lawful resident alien may not captiously be deprived of his constitutional rights to due process." This would not be relevant if Mezei were an unauthorized immigrant.
