Untitled

[edit]

Since the "Constitution" section only contains one article why make it a dropdown at all? Perhaps it'd be better just to be able to click on "Constitution" and go straight to Constitution of Belgium without worrying about show/hide?

Extra Space

[edit]

This is creating extra space on Communities,_regions_and_language_areas_of_Belgium. Fix.174.3.98.236 (talk) 08:54, 20 February 2010 (UTC)[reply]

Correctional court

[edit]

The correctional court is not part of the court of first instance, the correctional court is a penal court and 1st instance is a civilian court the third is the juvenile court all three are at arrondissement level --DerekvG (talk) 11:28, 27 June 2013 (UTC)[reply]

Judiciary

[edit]

I made some changes to the 'judiciary' section:

  • The Constitutional Court and the Council of State are not part of the judicial order; they are special jurisdictions that fall strictu sensu outside of the judiciary.
  • The courts of assizes can be classified as trial courts instead of appellate courts, since they adjudicate cases in first instance.
  • The civil tribunals, correctional tribunals and juvenile and family tribunals form together the 'tribunals of first instance'.
  • Courts of which there exist more than one are usually not capitalized (e.g. 'court of appeal', 'Court of Cassation').
  • The lower courts are best called 'tribunals', as that is literally what they're called in French; the name 'court' is rather reserved for the higher courts, such as the courts of appeal.
  • It's not necessary and potentially confusing to use the term 'federal judiciary', as there are no other judiciaries in Belgium on a Region or Community level. It's best to just call it the 'judiciary', without the word 'federal'.
