Public art like statues

I have a "must read" for you about the copyright for public statues and art https://commons.wikimedia.org/wiki/Commons:Public_art_and_copyrights_in_the_US . It's a requirement at Commons for art to comply with this section and I would expect the English Wikipedia to be the same. Royalbroil 03:11, 25 September 2013 (UTC)[reply]

There is no discussion on the listed page about fair use. I spoke with one of our attorneys this morning (City of Green Bay) and they have advised me that using the images is within fair use provided it is not for commercial purposes. Further, if I am acting as a representative of the City and using the images for non-commercial purposes, it is clearly fair use. Fair use isn't discussed because it is NEVER allowed at Commons. I have deleted a lot of statue and art images from Commons for these reasons. Fair use is against Commons' purpose of being strictly free use images (free means libre in this context). All images at Commons must allow for Commercial use (non-commercial restriction isn't allowed). Another main image concept is that derivatives must be allowed. You can do fair use here at the English Wikipedia. You've run into some of the snags that early Wikipedians always run into! I usually advise newer Wikipedians to stay away from images that they didn't take themselves, but you ran into the main problem with that advice (art / statue images).
Some Wikipedians wouldn't like your phrase about acting on behalf of the city. User accounts are actually supposed to be personal. Something to think about anyhow. Royalbroil 01:08, 26 September 2013 (UTC)[reply]
