- Unfortunately, I have to agree. If the colours/fonts were at least different, it would be ok on the basis that you can't copyright information, just its presentation, but this is clearly a copyvio. -mattbuck (Talk) 13:07, 11 September 2008 (UTC)[reply]
- Fortunately, it's easy to change the colors and other stuff. Easier to upload a new version. Getting there right away. :) Aditya(talk • contribs) 14:27, 11 September 2008 (UTC)[reply]

— Bellhalla (talk) 15:55, 12 September 2008 (UTC)[reply]A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. (emphasis added)
- I can gladly delete that if it's not needed, it was just a provisional sketch. But I maintain that it is in fact free. I believe I did not graphically base the drawing on either of the models to an extent that would make it a derivative work. I only used the pure information contained in them about the shape of the object depicted (information isn't copyrightable), and since the goal was to create a representation of an object as factually close to the object in them as possible, it is inevitable that there are similarities. The graphic realisation is as different as possible. Fut.Perf. ☼ 18:36, 12 September 2008 (UTC)[reply]
- Keep per Fut.Perf. I agree that this is not a derivative work in that all that is copied is what how the ship is shaped (and this is not owned by the artist or the photographer). We should be encouraging people with talent to do this more often (especially portraits of dead people where there is no free photo). Calliopejen1 (talk) 18:47, 12 September 2008 (UTC)[reply]

This article, which explains the origin of the Mao photos, seems to suggest that this is a September 1959 photo. And can we get some clarity on the PD-China tag? The one at commons doesn't have this caveat. Calliopejen1 (talk) 16:41, 12 September 2008 (UTC)[reply]

Image is probably a copyright violation. It is a low-resolution cover of a magazine. The author seems to claim by their username that they are an intern for that magazine and further claims that they've released the image under free licenses, but unless the unlikely claim can be substantiated, the image should be deleted as a copyvio. Nick—Contact/Contribs 19:21, 12 September 2008 (UTC)[reply]
- Deleted. Even if we take the caim of working for the magazine and creating the cover entierly on his or her own at face value (entierly possible) it still does not follow that the uploader have any rights to release this work. Aside from the work for hire provisions of copyright law you will be hard pressed to find an employer in any field who don't have some kind of clause related to transfer of intelectual property created during work to the hiering company as part of their standard employment contracts. It's therefore highly inprobable that an employee for a magazine (intern or otherwise) would not have had to sign something like that before beeing set to work creating the magazine's cover. --Sherool (talk) 15:52, 27 September 2008 (UTC)[reply]
