The result of the discussion was: mark with npd - uploader is on notice that we'll need confirmation for GFDL, and he has one week to get it. Sorry, we'd be far less qualified than you to search for that tweet (we don't know its contents, and some of us are unfamiliar with Twitter). - File:A1 Ferrari engine.jpg (delete | talk | history | logs).
- The uploader states that "Permission has been given by the author for use on Wikipedia.". However, a GFDL tag is applied, but there is no mention of this or the stated permission on the source page ([1]) Acather96 (talk) 17:14, 26 November 2010 (UTC)[reply]
- Permission was sought from user madeinhollywood on Twitter - after I noticed that he had taken the photo while actually attending an A1GP weekend, I then asked him on Twitter whether or not I could use it. If you dispute this, then you may wish to confirm with him yourself that I got permission, because I'm not going back through goodness knows how far back into the Twitter archive to get the one tweet that you really want. - File:Emigmonument.jpg (delete | talk | history | logs).
- per commons:Commons:Deletion requests/File:Hanko Emigmonument.jpg; same issue for the US. Magog the Ogre (talk) 20:54, 26 November 2010 (UTC)[reply]
- Well, freedom of panorama in Finland excludes images of sculptures only from commercial use (do a search for Lex Hiltunen), but fair use should be allowed in this case. Shall we include a fair use clause in the image specs instead of my original Gnu/CC license? (This of course means the image can't be on Commons, but Wikipedia is OK.) --Janke | Talk 07:17, 28 November 2010 (UTC)[reply]
- Here's some relevant text re FOP in Finland: Article 25a of the Finnish copyright law permits panorama freedom for buildings, both exteriors and interiors, regardless of whether the place is public (laws of privacy do apply). This, however, does not extend to works of art (other than architecture), when they constitute the central element of the picture. Pictures of works of art permanently located in public places can be used non-commercially or as illustrations to texts in newspapers and periodicals. I took the liberty of changing the license to Fair Use, and removed the deletion tag. --Janke | Talk 17:31, 30 November 2010 (UTC)[reply]
- Comment - again I reiterate that this is the English Wikipedia, and we go by US laws, not foreign law (it's a concept that comes up here a lot at PUF), unless we can prove that a photograph was in the public domain prior to URAA. Magog the Ogre (talk) 20:02, 10 December 2010 (UTC)[reply]
- Note: This image is currently tagged as non-free. If there is a dispute with the rationale, please tag the image with {{dfu}} or list it at WP:Non-free content review. Otherwise, unless there is another reason for listing here, the listing will be closed by an administrator and the image kept. AnomieBOT⚡ 21:27, 10 December 2010 (UTC)[reply]

The result of the discussion was: marked non-free - valid use of logo. If you disagree, by all means nominate with {{subst:dfu}}, although I still think it passes muster. Magog the Ogre (talk) 15:31, 12 December 2010 (UTC)[reply]
