The result of the discussion was: speedy delete - See Commons:Commons:Stock.xchng images - images from this site are unacceptable and speedied on site (their terms of service back in 2005 or so did not contain the terms in question, so there are some older images from them, but no new ones can be uploaded)

- Delete: the licencing page linked here clearly does not allow commercial use, so the image is not free enough for Wikipedia to use. ww2censor (talk) 00:31, 5 March 2011 (UTC)[reply]
- Keep: on the contrary and with all due respect, the image in question is entirely within Wikipedians' rights to maintain. A closer look at the aforementioned website reveals that this image may be used "in digital format on websites, multimedia presentations, broadcast film and video, [and] cell phones" (par. 4) as well as promotional materials, corporate promotions, and public decorations. Use on Wikipedia would fall under the first of these possibilities.
The same website asks that users not display the image for unlawful or immoral purposes nor for personal profit or gain of any kind (par. 5). Because there is quite literally no way to conduct either negative behavior through this Wikipedia page, this mandate does not concern us in the slightest.
Permission for use is only required in instances involving selling or distributing for personal gain, creating printed (that is, non-digital) reproductions, and producing in a widespread and commercial venue (par. 6).

- I received express permission from the copyright owner via Flicker (following WP rules for utilizing pics from same) to upload the file to WP and use it in the accompanying article. - Image has a copyright notice on it by the National Portrait Gallery (London), but uploader (mostly inactive nowadays it seems) tagged file PD-self. No proof that uploader is the copyright holder. Strange Passerby (talk • contribs • Editor review) 15:57, 5 March 2011 (UTC)[reply]
- Keep Here's the NPG page for it. It says that it was produced by the firm of Bassano Ltd, Royal Photographers, and from over 70 years ago, thus it is public domain. A quick search for "Shenton Thomas" on the NPG would have found this. —innotata 19:27, 15 March 2011 (UTC)[reply]
- It was taken over 70 years ago, but the page you linked says it was "given" to the NPG in 1974, thus it is still wholly possible that they own copyright. - Earlier I thought that this would probably be PD if unpublished under UK law, and was going to check. I guess not: commons:Commons:Licensing#United Kingdom.
