- My (the author of the picture) understanding is that buildings can not be copyrighted and that this includes sculpture that is part of the building. You can not copyright architectural sculpture in the USA. Carptrash (talk) 13:45, 11 April 2012 (UTC)[reply]
- Buildings completed before 1 December 1990 are not copyrighted, but more recent buildings are copyrighted, according to Commons:COM:FOP#United States. I'm not sure if artworks included in old buildings are in the public domain because of the building rule. In either case, the building isn't dated. It looks like a building meant to be lived in or worked in, so it fits the copyright definition of a "building". From Commons:COM:FOP#United States "However, the U.S. federal copyright law explicitly exempts photographs of such copyrighted buildings from the copyright of the building in 17 USC 120(a). Anyone may take photographs of buildings from public places. This includes such interior public spaces as lobbies, auditoriums, etc. The photographer holds the exclusive copyright to such an image (the architect or owner of the building has no say whatsoever), and may publish the image in any way." This painting is by a living artist - I posted two websites about him on the talk page. I am more used to being on the other end of this sort of discussion (see File:War & Peace in the San Luis Valley.jpg ) but perhaps someone who knows what to do should look into this.
