  • Under the NZ Copyright Act 1994, a letter may fall under the definition of a literary work (section 2) and is thus covered by the Act. The period of copyright for literary works is 50 years pma (section 22(1)). These are the same provisions as were made under the 1962 Copyright Act which was the governing legislation when the document was created in 1981.

As the document is only 31 years old it does not meet the criteria of being in the public domain in New Zealand or the US. The contention that the copyright period is only 25 years assumes that the letter is a typographical arrangement of a published edition under section 25 of the 1994 Act - as typographical arrangements apply only to the publishers and is not applicable in this case. What needs to be determined is the status of a letter and whether it is a literary work under section 2. NtheP (talk) 12:26, 28 December 2012 (UTC)[reply]

  • Insufficient substantiation of date of image, which raises questions about copyright. Uploader claims photo taken prior to 1923, but given source is silent on date.
