- The source is listed as Sekai no Kessakuki "Nihon Kaigun Suijō Teisatsuki" (世界の傑作機『日本海軍水上偵察機』). Amazon[4] lists this as published in 1996. This is not enough; a {{PD-Japan-oldphoto}} requires publication without a copyright notice before 1 March 1989 or publication without renewal before 1964 in order to be in the public domain in the United States. For what it is worth, the 1996 publication might be the first time the photo was published, and in that case, the photo is copyrighted in the United States until the end of 2064. The photo is, on the other hand, in the public domain in Japan. The rule of the shorter term is not used in the United States, so a Japanese photo might be copyrighted in the United States while being in the public domain in Japan. For that, it is necessary to identify a publication before 1 March 1989 and inspect that publication to determine if it complies with US formalities or not. - The photo did, indeed, enter the public domain in Japan in the 1950s. However, Japanese law only applies in Japan (and Europe and some other places), but Wikipedia is hosted in the United States. The copyright law of the United States says something different about Japanese photos from 1944. Check Wikipedia:Non-U.S. copyrights#Three-point test: a Japanese photo from 1944 may still be protected by copyright in the United States because of the third point in the test. Was the work published after January 1, 1923 but before the effective date of copyright relations between the source country and the United States? YES: The work is in the public domain in the United States. NO: The work should be assumed to be protected by U.S. copyright. It should only be used on Wikipedia if it falls within the fair use policy.
- In this case, the answer to the question is "NO". However, unless the first publication was after 1988, then it is usually fine as {{PD-URAA}}. However, please check Commons:COM:HIRTLE: "Works Published Abroad After 1 January 1978: 1 March 1989 or later: Published without copyright notice, and in the public domain in its source country as of URAA date: Use the US publication chart to determine duration". According to the US publication chart: "Works Registered or First Published in the U.S.: 1 March 1989 through 2002: Created before 1978 and first published in this period: The greater of the term specified in the previous entry or 31 December 2047". - Comment Based on username of uploader (User:ACT1) and name of website (actwon) and editing habits of the user, I'm inclined to agree that the photo is most likely made by the user as claims, but published elsewhere first, and with the user not fully understanding the legal complexities behind the copyright problem here, i.e. place of first publication and associated copyright status at place of first publication. I've alerted the user to WP:IOWN regarding previous publication of owned/created material so that they, if they are so inclined, can sort the problem out.
