  • Comment. FOP in Germany makes pictures of sculptures fine. The only issue here is permission to use this photo. The uploader has given some information, but not quite enough. Will get in contact with them shortly. — ξxplicit 02:07, 15 September 2015 (UTC)[reply]
Don't really know what else I can do to prove I have permission to use this. I did get written permission from the eBay seller to use it. Once this item is sold on eBay, the picture will be of no value to them (Deconamic) whatsoever. I am trying very carefully to be prudent about what I upload. I argue that this upload is completely above board and see no issues with copyright status. I realize there is a form people can fill out to release rights, but to non-Wikipedians it is almost impossible to understand. I went through this before when a photo I added to my Bad Rock Canyon article was deleted when I had written approval to use that one, too. I sent the form to the owner of the photo but they had no clue how to fill it out. --EditorExtraordinaire (talk) 04:46, 17 September 2015 (UTC)[reply]
  • The problem is that the eBay seller, who is the copyright holder in the photo, did not explicitly agree to the license you have stated. Their permission was so broadly worded that it does not guarantee the four freedoms of a free cultural work which we require on Wikipedia. The image must be deleted unless you can get explicit permission to use the image under that particular license from the copyright holder. BethNaught (talk) 21:31, 21 September 2015 (UTC)[reply]
  • Delete The uploader requested a Wikipedia-only permission from the eBay seller. The eBay seller didn't specify which permission he granted, so we have to assume that he granted the requested permission. This means that the file fails {{db-f3}}.   • The uploader claims that it is from his "personal collection" and not subject to copyright. This image can be found in Williams, Gerry (1999). Trains, Trolleys & Transit: A Guide to Philadelphia Area Rail Transit. Railpace Newsmagazine. and is credited to the author, Gerry Williams. Unless Oanabay04 (talk · contribs) is Gerry Williams, and there is no evidence for this, the file is unfree. This is another one of those incidents that really pisses me off. Another really nice image that turns out to be a copyvio, except that it's nicer than most of the ones that have been used. An Authentic Reading Railroad EMU still being used by SEPTS on a PRR line in the 1980's.
