The result of the discussion was: unlisted/speedy keep Image is unambiguously in the public domain as it was published in the United States prior to 1978 without a copyright notice.--Doug.(talk • contribs) 08:10, 16 July 2011 (UTC)[reply]
- Image is uloaded as "no copyright, published prior to 1978", however the photo is copyrighted. This can be seen in the original, uncropped photo, where the photographer's name/logo is included in the lower right corner. This is a typical rights mark used by photographers during this time period and indicates rights ownership. Night Ranger (talk) 00:52, 6 July 2011 (UTC)[reply]
- I do not see a copyright symbol on the original photograph. Having a photographer's name and logo may indicate many things, but it was not legally sufficient in the 1940 to copyright a work. The actual © symbol was what was necessary. Unless there is further evidence that the photo was actually copyrighted (not just "owned"), then keep. – Quadell (talk) 18:22, 6 July 2011 (UTC)[reply]
- United States Copyright Office page 2 "Visually Perceptible Copies The notice for visually perceptible copies should contain all three elements described below. They should appear together or in close proximity on the copies.
- 1 The symbol © (letter C in a circle); the word “Copyright”; or the abbreviation “Copr.”
- 2 The year of first publication. If the work is a derivative work or a compilation incorporating previously published material, the year date of first publication of the derivative work or compilation is sufficient. Examples of derivative works are translations or dramatizations; an example of a compilation is an anthology. The year may be omitted when a pictorial, graphic, or sculptural work, with accompanying textual matter, if any, is reproduced in or on greeting cards, postcards, stationery, jewelry, dolls, toys, or useful articles.
- 3 The name of the copyright owner, an abbreviation by which the name can be recognized, or a generally known alternative designation of owner.1 Example © 2007 Jane Doe." We hope (talk) 00:55, 11 July 2011 (UTC)[reply]

- Mixed history of two different people of this generic name, Milton Davis Jr. and Milton Jiricka, both deleted via PROD for lack of notability. The tags were never updated for the latter, so those revisions can fall to {{nld}} and {{nld}}. But give the history mess, confusing name (leading to history mess) and uselessness at this time, cleaner to delete and then if there's a need someone can upload the "right" one at an appropriate name with proper tagging. - Might not meet WP:PD#Fonts as the image appears to meet the threshold of originality to be copyrighted. Website from which this image appears to be taken states "[a]ll rights reserved" which is presumed to apply to this image as well; thus, this is believed to be an unused fair use image.
